Why can't I pay less maintenance since I don't use the pool or sauna?
Unit owners must pay maintenance on all of the common elements according to their proportionate share and may not be exempted from their portion by waiving use.
I don't watch the cable provided by the Association because I have satellite tv. Why do I have to pay for cable?
When cable service is a contract and is paid as a common expense of the Association, a unit owner may not waive their proportionate share even if they waive use.
I don't agree with the projects the Board adopted an assessment to pay for. Do I still have to pay?
Yes. A unit owner may not be exempted from paying for assessments unless all other unit owners are likewise exempted.
If I don't agree with how the common areas are being maintained, can I maintain a portion of them on my own?
No. It is the Board's responsibility to maintain the common elements. If a unit owner performs maintenance on the common elements on their own, and someone is injured as a result, they may be held personally responsible.
I want Satellite service, where can I install my satellite dish?
A unit owner may install a personal satellite dish limited in size on any portion of the property under their exclusive control.
Can I tint my windows or balcony doors?
That depends upon the contents of your condominium documents.
Can I record Board meetings?
Yes. Reasonable rules may be adopted to prevent interference with the Board meeting.
Can an owner continue to use the common elements if their unit is rented?
Generally no. Florida Statutes provides that a Board may adopt rules to prohibit dual usage. Most condominium documents contain a provision preventing separation of the common elements and appurtenances from the unit itself.
